§ 1525-100. PERMIT SUSPENSION

  • If any person who holds a Utility or Installation Permit violates any provisions of the permit or of this Chapter, the permit may be suspended by the Sutter County Building Inspector. The procedure for suspending the permits shall be as follows:

    (a)

    The Sutter County Building Department shall issue and serve upon the permittee a notice setting forth in what respect the provisions of the permit or of this Chapter have been violated, and shall notify him that unless these provisions have been complied with within thirty (30) days after the date of notice, the permit shall be subject to suspension.

    (b)

    The Notice shall be served by posting at least one copy in a conspicuous place on the premises described in the same permit, and by sending another copy by registered mail, postage prepaid, return receipt requested, to the person to whom the permit was issued at the address therein given.

    (c)

    Any permittee receiving a notice issued pursuant to this section may request and shall be granted a hearing upon the matter before an authorized representative of the Sutter County Building Department. The permittee shall file with the Sutter County Building Department a written petition requesting such hearing and setting forth a brief statement of the grounds therefore within ten (10) days of the date of mailing of such notice.

    (d)

    Upon receipt of such petition, the Sutter County Building Department shall set a time and place for such hearing and shall give the petitioner written notice thereof, at such hearing the petitioner shall be given an opportunity to be heard and to show cause, if any, why such notice should be modified or withdrawn.

    (e)

    Such hearing shall be commenced not later than ten (10) days after the date on which such petition was filed. Upon application of petitioner the Sutter County Building Department may, however, postpone the date of such hearing for a reasonable time beyond such ten (10) day period, if in its judgment the petitioner has submitted a good and sufficient reason for such postponement.

    (f)

    After such hearing, the Sutter County Building Inspector shall sustain, modify, or withdraw the notice, depending upon findings as to whether the provisions of this Chapter have been complied with.

    (g)

    If the requirements of the said notice have not been complied with on or before the expiration of thirty (30) days after the mailing and posting of the notice, the Sutter County Building Inspector may suspend the permit.

    (h)

    Upon compliance by the permittee with the provisions of this section and of the notice, and submission of proof thereof to the Sutter County Building Department the Sutter County Building Inspector shall reinstate the permit or issue a new permit.

    (i)

    If the permittee is dissatisfied with the determination of the Sutter County Building • Inspector following the hearing herein provided, the permittee may appeal such determination to the Board of Appeals established by Chapter 1300 of this Ordinance Code by filing a written appeal with the secretary of said Board within ten (10) days of the subject determination. Such appeal will be processed pursuant to the provisions of Chapter 1300 of the Sutter County Ordinance Code.
