§ 1060-070. SUBSCRIBER COMPLAINTS; FAILURE TO REMEDY

  • In addition to any other penalty provisions in the franchise, if a subscriber files in writing with the Grantor a complaint for a service problem which is preventable and reasonably within the Grantee's control, and if such Grantee fails within a reasonable period following receipt of written notice by the Grantor to remedy the problem, the Grantor may levy a penalty of up to five hundred dollars ($500.00) for any occurrence or series of related occurrences, unless the Grantee has fewer than 5,000 subscribers (in the Grantor) in which case the penalty shall not exceed two hundred dollars ($200.00). If the Grantee objects to the penalty in writing to the Grantor, within a reasonable period, the Grantee and Grantor may, upon mutual agreement, conduct arbitration in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final.
