§ 715-050. RIGHT OF ENTRY

  • The Sutter County Agricultural Commissioner and his or her designees (collectively Commissioner) may enter public or private property when there is reasonable cause to believe that sewage sludge or nonhazardous ash is being or has been applied or discharged on the property in violation of section 715-030. Before entering, the Commissioner shall obtain the consent of—

    (a)

    The occupant, if the property is occupied; or

    (b)

    The property owner or other person in control of the property, if the property is unoccupied.

    When requesting consent to entry, the Commissioner shall inform the occupant, property owner, or person in control that he or she may withhold consent and that, if consent is withheld, an inspection warrant may be sought. When consent to entry is withheld, the Commissioner may seek the Sutter County Counsel's assistance in applying to the Sutter County Consolidated Municipal and Superior Court for an inspection warrant authorizing the Commissioner to enter and inspect the property for violations of section 715-030.
