§ 420-060. APPLICATION

  • (a)

    The Sheriff shall act upon all applications in the following manner:

    (1)

    Applications received not less than 20 days before the proposed parade shall be acted upon within ten days.

    (2)

    Applications received between ten and 19 days before the proposed parade shall be acted upon within five days.

    (3)

    Applications received less than five days before the proposed parade shall be acted upon as soon as possible consistent with the maintenance of public safety and the orderly flow of vehicular and pedestrian traffic.

    (b)

    Permits may be denied by the Sheriff only upon his determination that one or more of the following conditions exist:

    (1)

    The time, route, and size of the parade will disrupt to an unreasonable extent the movement of other traffic.

    (2)

    The number of persons who would be inconvenienced by the parade will be grossly disproportionate to the number of the participants.

    (3)

    The parade will unduly interfere with ingress to or egress from or travel on a freeway or state designated highway.

    (4)

    A significant number of the participants have a specific intent, manifested by specific plans, to engage in or provoke violence.

    (5)

    The parade as proposed will interfere with another parade for which a permit has previously been issued.

    (6)

    The parade will occur between the hours of 6:30 a.m. to 9:30 a.m. or 4:00 p.m. to 7:00 p.m., Monday through Friday, unless the proposed date is a designated Sutter County holiday.

    (7)

    A fully enforced general curfew will be in effect at the time and place for the proposed parade.

    (8)

    The applicants have failed to make a timely application for a permit, and could have done so since the parade was not in response to an event of obvious importance.

    (c)

    The Sheriff shall not revoke any permit previously granted except upon a finding of one or more of the circumstances described in subsections (b)(1) through (b)(8) immediately above.
