§ 215-120. VIOLATIONS

  • Violation of this chapter is unlawful and may be prosecuted as either a misdemeanor or an infraction, at the discretion of the district attorney. Violation of this chapter shall be punishable as follows:

    (a)

    Every person convicted of an infraction shall be punished by a fine not exceeding one hundred dollars ($100.00) upon a first conviction, by a fine not exceeding two hundred dollars ($200.00) upon a second conviction of the same provision within a period of one year, and by a fine not exceeding five hundred dollars ($500.0) upon a third or any subsequent conviction of the same provision within a period of one year. For purpose of this subsection, a bail forfeiture shall be deemed to be a conviction of the offense charged.

    (b)

    Every person convicted of a misdemeanor shall be punished by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment in the Sutter County jail for not more than six months, or by both such fine and imprisonment.
