§ 72-020. ORGANIZATION, MEMBERSHIP, TERMS, APPOINTMENT, REMOVAL, COMPENSATION

  • The organization, membership, terms, and methods of appointment and removal of members, and their compensation, shall be as follows:

    (a)

    There shall be seven members of the Commission.

    (b)

    Each of the five supervisors shall select and appoint one member of the Sutter County Planning Commission from among the residents of said supervisor's district. Each member of said Commission so appointed shall serve a term of the same duration as the supervisor who appointed said Commissioner and at the pleasure of said supervisor. A Commissioner may be removed at any time, with or without cause, by the supervisor who appointed said Planning Commissioner or by a four-fifths vote of the Board of Supervisors.

    (c)

    The sixth member of the Commission shall be nominated by the Yuba City City Council from among the members of the Yuba City Planning Commission and shall be appointed by no less than a three-fifths vote of the Board of Supervisors provided, however, that any member so appointed may be removed by a three-fifths vote of the Board of Supervisors.

    (d)

    The seventh member of the Commission shall be nominated by the Live Oak City Council from among the members of the Live Oak Planning Commission and shall be appointed by no less than three-fifths vote of the Board of Supervisors provided, however, that any member so appointed may be removed by a three-fifths vote of the Board of Supervisors.

    (e)

    Any Planning Commissioner appointed to fill a vacancy occurring during a term shall serve for the remainder of the unexpired term of the office vacated and all appointees, so long as they remain qualified, shall serve until their successor is appointed and qualifies. The term of all Commissioners serving as such on the effective date of this ordinance shall terminate as of that date.

    (f)

    With regard to the sixth and seventh members of the Commission, current, continuing membership in the Yuba City Planning Commission and in the City of Live Oak Planning Commission respectively shall be a prerequisite to the holding of office in the Sutter County Planning Commission, and shall either of the persons so selected and appointed by the Board of Supervisors cease to be a member of the respective Planning Commission his membership on the Sutter County Planning Commission shall thereafter immediately cease and his office therein shall be considered vacant.

    (g)

    Annually, on the first regular meeting in January of each year, the Commission shall hold it organizational meeting, at which time it shall select a chairperson to preside over its meetings for the remainder of the year. At said time, it shall likewise select a vice-chairperson. Said chairperson and vice-chairperson shall be selected from the membership appointed pursuant to Section 72-020(b) of this chapter. Unless otherwise determined by the Commission, the Planning Manager shall be designated as the secretary. The Commission may appoint other officers necessary to its function. No person shall serve as chairperson for more than two consecutive years.
