§ 1060-200. FAILURE TO PERFORM STREET WORK

  • Upon failure of the Grantee to commence, pursue or complete any work required by law or by the provisions of this chapter or by its franchise to be done in any street or other public place, within the time prescribed, and to the satisfaction of the Development Services Department Director. The Development Services Department Director, at his option, may cause such work to be done and the Grantee shall pay to the Grantor the cost thereof in the itemized amounts reported by the Development Services Department Director to the Grantee within 30 days after receipt of such itemized report. Except for emergencies when, in Grantor's judgment, there is a likelihood of serious risk of injury to the public, Grantor agrees to give Grantee written notice of no less than 30 days, of any alleged work failure and provide for a reasonable period to cure.
